Dear Dr Bell, RE: YOUR DRAFT "2ND OPINION" ASSESSMENT EMAILED TO ME BY MS YVONNE McCAMBLEY ON SEPTEMBER 28th 2018 Thank you for your draft "2nd opinion" assessment based on my hour long appointment with you on August 29th, which I received on September 28th. It seems that Yvonne McCambley (Medical Secretary) had earlier sent me letters that I never received. As I felt I needed more time to consider the contents of your draft assessment, I emailed Yvonne McCambley early on October 1st regarding this matter. A copy of my October 1st email to Yvonne McCambley can be viewed at the following www location: http://www.humanrightsireland.com/ConsultantPsychiatristDrPaulBell/1October2018/Gmail.pdf Due to the 60 minute time restriction of my August 29th appointment with you, there were a number of issues connected with my situation which I was unable to relate to you during the appointment, which are not mentioned in your draft assessment, and which I suspect you may be unaware of. With this in mind, I now wish to respond, in an overall way, to your "2nd opinion" draft assessment as set out in the following list: 1) For several years now I have owned my own home ("St Albans") in the Republic of Ireland (in the village of New Inn, County Galway), and I wish to be able to return to live in it. The home of my brother (Gerald Finnerty), and the home of my half-sister (Marjorie Dolan) are both located in the same village. On account of the difficulties I ran into with "public officials and bodies" immediately after I returned to live in Galway in 1998, and the fact that there were some fairly small jobs that needed doing in my own home before I moved in, such as carpet laying for example, I never actually did move in; and, instead stayed in my brother's home on what I believed would be a short-term temporary basis. In the meantime, and as a result of having to live in "forced exile" for several years between then and now, because that was the only way I could avoid being corruptly criminalised in the Republic of Ireland, my home in New Inn has since gone derelict, and it will require a considerable sum of money to make it habitable again. Also, and allowing for the fact my older brother has had a number of medical problems in recent years, which have involved hospitalisations, I would like to be able to go to see him (and my half-sister) in the Republic of Ireland: without having to run the risk of being arrested and imprisoned in connection with false claims that I have committed crime in the Republic of Ireland. (Please know that I do not have any criminal convictions from any of the several different jurisdictions I have lived in.) I have not seen my brother or half-sister since the early part of July 2015, and I do not know when, if ever, I will see them again: having due regard for the unresolved problems relating to my present legal situation, as referred to below. When I came to Northern Ireland in July 2015 it was my belief that, under the terms of Article 18 ("The right to asylum") of the CHARTER OF FUNDAMENTAL RIGHTS OF THE EUROPEAN UNION, I would be able to receive the professional legal help I needed in order to return safely to the Republic of Ireland, within a few weeks, or at most a few months. I sent an email regarding this matter to Ms Josie Mulherin, Clerk of Loughrea District Court (County Galway) on July 9th 2015, a copy of which can be viewed at: http://www.humanrightsireland.com/LoughreaDistrictCourt/9July2015/Email.htm Please know that the email at the above www address was copied to several "public officials and bodies" other than Ms Josie Mulherin. In addition, I sent a signed printout of this email through the registered post to Ms Mulherin, also on July 9th 2015. Consequently, I have no way of knowing if they were received by the people I tried to send them to. More importantly, I still do not have any tangible evidence of the existence of an extant warrant for my arrest in the Republic of Ireland, which is making it difficult for me to get legal representation here in Northern Ireland, as I have related to Ms Louise Arthurs (Lawyer) at the Belfast Branch of the Northern Ireland Law Centre in my August 4th 2017 email to her at: http://www.humanrightsireland.com/TheNorthernIrelandLawCentre/4August2017/Gmail.html === === === 3) There is no reference in your "draft assessment" of the letter I sent to you through the registered post on August 17th 2018, and as far as I can recall, you did not mention it to me when I saw you during my appointment with you on August 29th. Consequently, I do not know if you have received this registered letter. As you can see, the piece of text in question contains a link to an email I sent to the Northern Ireland Justice Department dated August 8th 2018, in which I outlined several parts of the overall "WRONGDOING BY PUBLIC OFFICIALS AND BODIES IN THE REPUBLIC OF IRELAND". A copy of the August 8th 2018 email can be viewed at: http://www.humanrightsireland.com/NorthernIrelandJusticeDepartment/8August2018/Gmail.html An important aspect (for me) of the "Republic of Ireland's judicial corruption problem" is that I have never been able to find any professional legal representation in the Republic of Ireland which recognises and supports (in practical ways) what I see as certain crucially important parts of the Constitution (i.e. the SUPREME LAW) of the Republic of Ireland, which is also known as "Bunreacht na hEireann". Among the most important of the parts which I believe are being all too often violated is Article 6.1, which reads (in full) as follows: “All powers of government, legislative, executive and judicial, derive, under God, from the people , whose right it is to designate the rulers of the State and, in final appeal, to decide all questions of national policy, according to the requirements of the common good.” The above statement has always appeared to me to be powerfully representative, and supportive of, what many now regard as the best definition there is of what a modern, genuinely democratic, republican government should be, as defined by former President of the Republic of the United States of America Abraham Lincoln, using the words "government of the people, by the people, for the people". The first "hard evidence" of the Article 6.1 violations I came across involved plans for a large rubbish dump in Kilconnell (East County Galway), which was later constructed and opened (only to be mysteriously shut down not all that long afterwards), and which is located a few miles from my home in the village of New Inn. This same difficulty also appears (to me), based on my own personal experiences, to be something of a problem in Northern Ireland, and in England as well. This is partly because of concerns relating to the associated side-effects I have read about, and partly because I have had some very bad experiences in the past with medications in this category. I have been completely free of such medications for many years now, and I would prefer not to get involved with them again if possible. Also, deep down, and for many years now, I feel I am far more in need of professional legal representation of the kind which recognises and supports (in practical ways) constitutional law and human rights law, than I am of psychiatric type medications. Nonetheless, if at any time in the future I feel the C-PTSD (Complex Post Traumatic Stress Disorder) / PTSD (Post Traumatic Stress Disorder) PTSD type symptoms I suffer from become too much for me to cope with, without the help of psychiatric medications, it is my intention to ask Dr David Cheyne GP, my present GP, to provide me with a prescription for the Sertraline and Olanzapine drugs you have kindly informed me about. SociallyDestructiveForces The C-PTSD / PTSD type symptoms I am suffering from are, as I see things, the direct result of being at the receiving end -- for the past 20 years or so -- of what I have come see and to think of as a combination of "government corruption, crime, cover ups, bullying, and impunity". In connection with my present situation, Article 47 of this Charter seems particularly important to me, and a slightly edited version of it reads as follows: "Article 47 "Right to an effective remedy and to a fair trial "Everyone whose rights and freedoms guaranteed by the law of the Union are violated has the right to an effective remedy before a tribunal in compliance with the conditions laid down in this Article. "Everyone is entitled to a fair and public hearing within a reasonable time by an independent and impartial tribunal previously established by law. Everyone shall have the possibility of being advised, defended and represented. "Legal aid shall be made available to those who lack sufficient resources in so far as such aid is necessary to ensure effective access to justice." I included a copy of his diagnosis with the registered letter (referred to in Section 3 above) which I sent to you on August 17th 2018. A scanned copy of Dr McCavert's October 28th 2005 letter can be viewed at: http://www.humanrightsireland.com/ConsultantPsychiatristDrPaulBell/17August2018/RegisteredLetter.html The main reasons I have always believed, and continue to believe, that Dr McCavert's diagnosis is entirely correct are because: a) Since around Year 2,000 I have constantly been suffering from the set of symptoms listed at the www address immediately below, which are listed under the heading "Common symptoms of PTSD and Complex PTSD that sufferers report experiencing" at: http://bullyonline.org/old/stress/ptsd.htm#Symptoms b) While living in Omagh (County Tyrone, Northern Ireland), and with the help of Senior Psychiatric Social Worker Gerry Madden, who is mentioned in Dr McCavert's "To Whom It May Concern" letter referred to above, I was provided with disability benefit for C-PTSD on account of the living difficulties I was experiencing at the time, and which have not altered significantly since then. I believe Gerry Madden was influenced by the fact that I identified very strongly with the contents of an Irish Times Article written by Psychologist Dr Marie Murray titled "Dealing with injustice", a copy of which he handed me on April 19th 2006: particularly the statement *"It is excruciatingly visceral". A copy of this "Dealing with injustice" publication can be viewed at: http://www.europeancourtofhumanrightswilliamfinnerty.com/MarieMurray19April2006/IrishTimesArticle.htm c) While living in Galway (Republic of Ireland), and in connection with help I received from Republic of Ireland Consultant Psychiatrist Dr Anne Jeffers, I was also diagnosed as suffering from C-PTSD, and accordingly provided with disability benefit on account of the living difficulties I was experiencing. Later, the Republic of Ireland authorities informed me they were going to merge these disability payments with my claim for the old age pension (which fell due at a later time); and, for no good reason that I know of, they then went on to refuse to pay me either. For several years following that my brother (Gerald Finnerty) and my half-sister (Marjorie Dolan) paid me my old age pension, in effect. This is the main reason I needed to start borrowing money from them several years ago against my home in New Inn. However, I felt it would be futile for me to apply for them in circumstances whereby I did not know what the final outcome was of the several "assessment appointments" I had with Consultant Psychiatrist Dr Mark McCauley and Consultant Psychologist Dr Elizabeth McMonagle at Daisy Hill Hospital in Newry during 2015 and 2016. Consequently, I have no way of knowing if Dr John Radcliffe GP and his colleagues at Meadowlands Surgery know anything about these two letters. === === === 8) I see impunity -- of the kind described in the United Nations excerpt just below -- as the main cause of the ongoing set of C-PTSD / PTSD type symptoms I am suffering from; and, for many years now I have also seen it as the main obstacle in the way of my recovery from the set of C-PTSD / PTSD type afflictions I continue to suffer from. "Impunity means the impossibility, de jure or de facto, of bringing the perpetrators of violations to account - whether in criminal, civil, administrative or disciplinary proceedings - since they are not subject to any inquiry that might lead to their being accused, arrested, tried and, if found guilty, sentenced to appropriate penalties, and to making reparations to their victims". Since the first of these occurred, I have believed that I am suffering from both PTSD, and from C-PTSD (Complex-Post Traumatic Stress Disorder). The first of these two incidents, which I related to you on August 29th, and which I think of as my very public "Machine Gun Interview", happened on Sunday, August 31st 2008. Due to the time restrictions relating to my August 29th appointment with you I was unable to inform you regarding this murder attempt incident. I wrote to Catherine Hughes (Manager) at the Northern Ireland Pension Service about this on September 6th 2018. Consequently, I have no way of knowing if Catherine Hughes is aware of my September 6th 2018 letter to her. === === === 12) One of the reasons I have delayed this letter to you is that I have been waiting to see if I received any reply to an email I sent to Republic of Ireland Chief Police Commissioner Drew Harris on October 5th 2018, which was titled "A new way to report corruption in the Republic of Ireland". This leaves me feeling that all such assurances from the Republic of Ireland Government, relating to the tackling of corruption in the Republic of Ireland, are in all probability completely meaningless at the present time. === === === There are a few things in the draft "2nd opinion" assessment I received from Yvonne McCambley (Medical Secretary) on September 28th which I feel need to be altered. However, and as I see these few things as being relatively unimportant, I feel it is best for me not to try to deal with them in this letter. Instead, I would prefer to very briefly discuss them with you during my next appointment.
