Dear Ms Arthurs,
Following on from my email to you of July 31st 2017, my query relates to
the possibility that The Belfast Branch of the Northern Ireland Law
Centre might be able to help me to resolve a set of "legal and medical
difficulties" which has steadily grown more complicated over the past nineteen
years or so, and which has left me suffering from chronic Post Traumatic
Stress Disorder (PTSD) for a continuous period of approximately 17 years
now (i.e. from Year 2000 to the present time), and debts in excess of Euros
80,000 which I owe to my brother (Mr Gerald Finnerty) and my half-sister
(Ms Marjorie Dolan), who are both domiciled in the Republic of Ireland,
in the same village that my own home is located in.
Evidence of the PTSD I am
suffering from, and the REASONS why I have ended up suffering from
this medical condition, can be found in the attached copy of the "To
Whom It May Concern" letter dated October 28th 2005
from my former GP, Dr Michael McCavert.
One very disturbing aspect for me of the set of difficulties in question is that there is an
extent warrant for my arrest in the Republic of Ireland which is
preventing me from returning to my home in County Galway (Republic of
Ireland). Through their "Free Consultation & Legal Advice"
service, Oracle
Solicitors in central Belfast kindly offered me the opportunity to
discuss this particular aspect of my present situation with a member of their staff on July 28th
2017, for a period of up to one hour. During the
discussion, the member of staff I spoke with, Ms Carolyn Rhodes, decided
I did not have a case which her law firm could take on; and,
assuming I understood her correctly, the main reasons for this include the
following:
a) I do not have any tangible evidence to show that there actually is an
extant warrant for my arrest in the Republic of Ireland, which I have
been told was issued on July 8th 2015,
b) I do not have any tangible evidence of any attempt by the authorities
in the Republic of Ireland to have me extradited from Northern Ireland;
c) I do not have any tangible evidence to show that I am receiving any
medical treatment for the PTSD condition I am suffering from (because I am not receiving any);
and,
d) As a consequence of what I have related just above under a), b), and
c), Ms Rhodes felt that it was most unlikely I would be granted legal aid.
Catch22
However, in connection with the fact that the medical treatment I had
started to receive from a psychologist at Daisy Hill Hospital in Newry,
in 2016, was suddenly cancelled on account of the fact that I had
unresolved legal problems, Ms Rhodes advised me to contact The Law
Centre regarding this "Chicken and Egg"/ "Catch 22" type situation
I have been trapped in for several years now, whereby the legal
profession claims it cannot provide me with legal help on account of the fact
that, among other things, I am
not receiving any medical treatment for PTSD; and, at the same time, that the medical profession
is unable to provide me with medical help because of my unresolved
legal problems. I feel I should point out that at the very end of my
meeting with Ms Rhodes, she made it clear to me that, allowing for the
situation related under a) to d) above, Oracle Solicitors are unable to
take on my case, and that consequently I am not a client of theirs:
which means I still do not have any legal representation.
There is one particular aspect of my present "medical situation" which I
feel deserves special attention, and that relates to the fact that I
have a "prostate gland" problem. Additional information regarding the
difficulties involved can be found in the copies of the two letters at the
www location immediately below. One of the two letters, dated February
20th 2017, was written by Craigavon Hospital Consultant Mr Anthony

I wish to also point out that, due to the time restrictions, the medical matter
referred to in the paragraph immediately above was not discussed during
my meeting with Ms Rhodes on July 28th last (referred to above).
In the hope that The Northern Ireland Law Centre might be able to help
me in connection with the above-mentioned difficulties, I am including
additional information relating to my overall situation in the Appendix
below, should you consider it appropriate to take account of it in connection
with this query of mine.

from a few hours to several days, and on a number of occasions, for much
longer than that. Ideally, and in so far as it is possible of course, it
seems best that I try to avoid talking to people who have little or no
knowledge, or training, regarding the matter of helping people who are
suffering from PTSD.

In 2016 I sought help from one of the largest political parties in
Northern Ireland, and was advised that, as they viewed my core difficulty
as being entirely legal, and not political, I should contact The Law

Item #3: Deep puzzlement for me regarding the policing and the
enforcement of European Union Human Rights Law in both Northern Ireland,
and in the Republic of Ireland
The text of Article 47 of THE CHARTER OF FUNDAMENTAL RIGHTS OF THE
EUROPEAN UNION:
"Right to an effective remedy and to a fair trial"
"Everyone whose rights and freedoms guaranteed by the law of the Union
are violated has the right to an effective remedy before a tribunal in
compliance with the conditions laid down in this Article."
"Everyone is entitled to a fair and public hearing within a reasonable
time by an independent and impartial tribunal previously established by
law. Everyone shall have the possibility of being advised, defended and
represented."
"Legal aid shall be made available to those who lack sufficient
resources in so far as such aid is necessary to ensure effective access
to justice."
Why, I frequently find myself wondering, allowing for the text just
above, and other similar human rights law texts, am I having such enormous difficulty, over a period of several
years, i.e. since well before I received the attached "To Whom It May
Concern" letter dated October 28th 2005 from Dr Michael McCavert GP, with finding legal representation regarding,
for example, the extant warrant
for my arrest which apparently exists in the Republic of Ireland?

Item #5: Problems with Old Age Pension and the Discretionary Support
Service
It appears that I am being penalised -- albeit unintentionally I imagine
-- for wanting to return to my home in the Republic of Ireland. Part of
my Old Age Pension has been disallowed, and I have been refused help
from the Discretionary Support Service as well, in connection with the
way the value of my home in County Galway is being taken into account,
while, at the same time, my debts to my brother and half-sister are being completely
ignored.
It seems that the only way I can remedy this
problem is by disposing of my home in the Republic of Ireland, which makes no
sense to me, when account is taken of the fact that I wish to return to
it.
Assuming that there really is an extant warrant for my arrest in the
Republic of Ireland, it appears to me that, if I return to the Republic
of Ireland, I can very easily be arrested at any time, imprisoned, criminalised, and
possibly fined -- all through the use of a "Trial by Judge" court hearing,
i.e. I have been told there is no "Trial by Jury" option available to me -- in connection the completely false claim that I have
committed crime in the Republic of Ireland.
