"NOT SO THE OTHER WAY AROUND OF COURSE !!!"
Philomena,
Many thanks for your reply (at
https://www.facebook.com/william.finnerty.3/posts/10205769105889540 ), which
I very much appreciate.
In many respects, things really are in a truly terrible state here (in the
Republic of Ireland), and (for me) your above-mentioned reply reflects all of
that very well.
For some time now, and for my own purposes, I have tended to sum up and
"package" the overall "set of causes" (as I see them) of all the negative things
you have mentioned (and some more perhaps) under the heading of:
"Government corruption, crime, cover ups, bullying, and impunity."
Impunity is the one that most worries me, because, among several other things,
it means "the people", and/or individual members of the general-public such as
myself (for example), can never -- in effect -- challenge the government in our
"courts of law", at least not in any effective way.
NOT SO THE OTHER WAY AROUND OF COURSE !!!
NOT BY A VERY LONG WAY!!!
We, "the people" on the other hand, find ourselves in a situation where "street
protests" are the ONLY thing we have (more or less) to "resist" government
wrongdoing with (initially at least); and, as we have seen time and again here
in the Republic of Ireland in recent years -- and again, and again, and again --
the Government can very easily "deal" with this form of resistance from the
general-public by simply criminalising and imprisoning one or more of the
protesters on some PRETEXT or other (which can itself be as fraudulent as
fraudulent can be, and "100% plus" the product of outrageous corruption in its
own right of course) using the "trial by judge" arrangement (NOT "trial by jury"
please note): and thus deflect public attention away from all of the extremely
serious "government crime" that is involved: such as, for example, the
unrelenting and blatant violations here of Article 6.1 of Bunreacht na hEireann
by the THREE MAIN BRANCHES of our Government (Executive, Legislative, and
Judicial): unrelenting and blatant violations, that is, of THE SUPREME LAW OF THE
REPUBLIC OF IRELAND, by the three main branches of our own Republic of Ireland
Government.
This is a nice "how do you do" we find ourselves in, is it not?
It reminds me of the "Laurel & Hardy" line: "That's another fine mess you've
gotten me into Stanley!".
In this case, it's possibly more a question of:
"Another fine mess 'humanity as a whole' has gotten itself into"?
Many times I have found myself wondering about the possibility that the overall
global version of the "government corruption, crime, cover ups, bullying, and
impunity" problem may have already "crossed some invisible line" -- in terms of
growth and strength, like a deadly social-cancer of some kind that is being
fuelled mainly by the "Money Power Psychopaths" -- whereby the by now rampant
"cancer" has taken on a "life of its own", and is -- in reality maybe? -- no
longer stoppable by any means known to "humanity as a whole"?
While I hope that that has not actually yet happened of course, to be very open
and honest about it all, I frequently feel a very long way off from being convinced that
it hasn't.
I only found out yesterday that Paul Murphy TD (who as you will no doubt know is
very closely associated with the "Irish Water" protesters) has a degree in law
from Dublin University (which he received some years ago). Today I find myself
wondering, allowing for the fact he has had a law degree for several years now,
why he has not already organised a "court room" challenge of some kind against
our Government: weeks, or even months ago, to either run in parallel with the
"street protests"; or, better still, to "kill off" the need for street protests
altogether (in this particular case)?
Unfortunately, as a direct result of my own bitter experiences over the past 16
years or so, I feel I probably know what the answer is to the question raised in
the paragraph just above; and, I strongly suspect it is this: our
corruption-ridden and government-crime-supporting legal profession will not --
UNDER ANY CIRCUMSTANCES -- allow any such "court room" challenge; and, that there is
NOTHING -- at the present time -- that ANYBODY (I know of) can do about this
very bizarre, but all too common practice of the legal profession itself
knowingly, wilfully, and very deliberately, "perverting
the course of justice" in extremely serious ways: thanks entirely, or almost entirely, to IMPUNITY;
and, doing so with TOTAL IMPUNITY of
course!!
Impunity:
"Impunity means the impossibility, de jure or de facto, of bringing the
perpetrators of violations to account - whether in criminal, civil,
administrative or disciplinary proceedings - since they are not subject to any
inquiry that might lead to their being accused, arrested, tried and, if found
guilty, sentenced to appropriate penalties, and to making reparations to their
victims." (From

The Tripartite Division of Powers of the Republic of Ireland
Government ...
Using the words of Dublin based barrister and law-lecturer Brian Doolan
(from his book titled "Principles of Irish Law", on Page 11 of the
Fifth Edition), the core expectation of abiding by the tripartite separation
of powers doctrine is that the
"Abuse of power by (any) one (of the three main branches of government) can
be checked by (any one or both of) the others, and tyranny, hopefully, is
prevented".'
The excerpt immediately above is from:
http://www.indymedia.ie/article/82176#comment191310
"The Constitution of the Republic of Ireland, according to
(former Chief Justice)
O'Dalaigh CJ. re Haughey (1971), is founded
on the doctrine of the tripartite division of powers of government (i.e.
between the three main branches of government: legislative, executive and
judicial)."

So why is it, that for the past two decades or so (at least), in connection
with a long string of exceptionally important social issues for "the
people" of the Republic of Ireland, such as the
"MULTI BILLION EUROS BANK
BAILOUT" for example, ALL of the three
main branches of the Republic of Ireland Government (Executive, Legislative,
and Judicial) have been ACTING AS ONE regarding the wholly UNLAWFUL practice
of USURPING the Bunreacht na hEireann (Constitution of the Republic of
Ireland) Article 6.1 SUPREME LAW RIGHT of "the people"
to have the "final" say in deciding "all questions
of national policy, according to the requirements of the common good."
???
Article 6.1 of Bunreacht na hEireann reads (in full) as follows:
"All powers of government, legislative,
executive and judicial, derive, under God,
from the people,
whose right it is to designate the rulers of the
State and, in final appeal, to decide all
questions of national policy, according to the
requirements of the common good."
GOVERNMENT USURPATION:
"The tyrannical
assumption of the
government by force
contrary to and in
violation of the
constitution of the
country."
