AN ATTACK ON TRUTH, ON REALITY, AND ON OUR CONSTITUTION ?
"If a Bill is constitutional, he (President Michael D. Higgins) has
to sign it. It's not his choice as to whether he signs it or not."
Although I'm not a lawyer, I'm nevertheless entir ely convinced that the
above statement is both false, and, far more importantly perhaps, also
dangerously misleading in terms of the promotion of social well-being, and social
stability.
Article 26 1 1° of the Constitution of the Republic of Ireland clearly
states:
"The President may, after consultation with the Council of State,
refer any Bill to which this Article applies to the Supreme Court for a
decision on the question as to whether such Bill or any specified
provision or provisions of such Bill is or are repugnant to this
Constitution or to any provision thereof."
The contents of Article 26 1 1° of the Constitution of the Republic of
Ireland can easily be checked by anybody with access to the "www
System", by clicking on the following www link:

In other words (as I see things), it is entirely acceptable for all
Republic of Ireland Presidents to have doubts regarding the
constitutionality of ANY Bill brought before them "to which this Article
applies"; and, if the President has any such doubts, he or she can refer
it to the Supreme Court for a decision: provided that he or she first
consults with the Council of State using the formal procedure provided
by the Constitution for doing so. Importantly, and in so far as I know,
the President is not at all bound by the views and opinions of the
Council of State in such matters; and, regardless of what the members of
the Council of State think or decide as individuals, or collectively,
the President, and the President alone, has the final say on whether or
not he or she refers "any Bill to which this Article applies to the
Supreme Court".
The above statement "If a Bill is constitutional, he (President) has to
sign it. It's not his choice as to whether he signs it or not", appeared
in an
RTE
(National Broadcaster) Article dated
January
28th 2015, and is attributed by RTE to
Republic of Ireland Minister for Health Dr Leo Varadkar TD. A full copy of the RTE Article

I have no way of knowing whether this potentially EXTREMELY dangerous
piece of "disinformation" (as I see it) is deliberate, or accidental.
Either way, it does not seem at all good to me, and I hope RTE and
Minister Varadkar will correct it without undue delay: for the sake of
the State of the Republic of Ireland, and for the sake of all of the
citizens (present and future) of the Republic of Ireland: keeping in
mind that Bunreacht na hEireann (the Constitution of the Republic of
Ireland) is the SUPREME LAW of the Republic of Ireland.
If either or both (RTE and/or Minister Varadkar) fail to do so, then I
hope (at least) that "the people" are not going to be fooled by the
misleading "It's not his choice" claim referred to above: especially
"the people" who protest on our streets by peaceful and lawful means
against government policies which they consider unjust, and/or NOT in the
interests of the "common good". Article 6.1 of our Constitution clearly
states:
"All powers of government, legislative, executive and judicial, derive,
under God, from the people, whose right it is to designate the rulers of
the State and, in final appeal, to decide all questions of national
policy, according to the requirements of the common good."
Ultimately, in the Republic of Ireland, and as is entirely fitting for a
"Republic", it's "the people" who have the
"final" say -- according to
the SUPREME LAW of the land -- regarding "all questions of national
policy": unless of course members of the Government (Executive,
Legislative, and Judicial), and/or the MSM (Main Stream Media), succeed
in hoodwinking "the people" into believing otherwise.

Mindful of the old-saying "If the cap fits, wear it", I sent a
"marked-up printout" of an email through the REGISTERED POST to
Republic
of Ireland Health Minister Dr Leo Varadkar TD last Monday (January 26th
2015).
The email was titled:

GOVERNMENTS ...

RE: Two other Republic of Ireland members of Government (of many!!), who
might very usefully (in my opinion) 'try on the "NARCISSISTS" AND/OR
"PSYCHOPATHS" cap' for size:
' NOTE ADDED on January 16th 2015: The entire existence, and the entire
contents, of Dr Michael McCavert's October 28th 2005 "To Whom It May
Concern" letter continue to be completely ignored by
Minister for Social
Protection Joan Burton TD, and by President Michael D Higgins; and, for
no good reason that William Finnerty knows of, allowing for the contents
of two registered letters referred to just above, he STILL receives no
old age pension: which he is fully entitled to by law. Since March 2011,
close relatives have, in effect, been partly paying William Finnerty his
old age pension by lending him money "against his home" each month,
until the "government non-payment" problem gets resolved; and, doing so
on the clear understanding that the borrowed money will be repaid in
full to his close relatives as soon as possible after the "government
non-payment" problem is corrected. '
