Dear Ms Moley,
I called into the local Housing Executive Office (35-45 Boat Street,
Newry) just after lunchtime yesterday, mostly for the purpose of trying
to have my belongings at "31 Kilmorey Street (Newry)" taken to the
temporary address that I have recently been provided with (by the
Housing Executive).
Initially, I was very heartened by the fact that Niall Fitzpatrick
(Housing Executive Team Leader), and Michael Keenan (who I understand is
part of Niall Fitzpatrick's Team), were both very willing and happy
to go around -- "there and then" -- to 31 Kilmorey Street, to collect my
belongings, on my behalf, and to transport them from there to my present
temporary address.
However, when Michael Keenan then contacted Clanrye Properties Manager
John Hughes on the phone to make arrangements for the collection of my
belongings, John Hughes informed him that it would not be possible for
them to do so.
Apparently, as I understand it, Clanrye Properties Owner Patsy Heaney
has made arrangements for my belongings to be locked away in a room at
31 Kilmorey Street, and he has also made arrangements for the key of the
room in question to be placed in a safe (at 31 Kilmorey Street), which
John Hughes has no access to. John Hughes further advised Michael Keenan
that Patsy Hughes is at present on holiday in Thailand, and is not
expected back in Northern Ireland until the end of January 2016.
Allowing for the fact that Newry-based Police Constable Sheila Morton
has strongly advised me, during my meeting with her in the Canal Court
Hotel on December 11th 2015, to make arrangements to have my belongings
removed from 31 Kilmorey Street as soon as I possibly could, I now find
myself wondering if the manner in which Clanrye Properties are holding
onto my belongings (as outlined above) is lawful?
If the manner in which Clanrye Properties are holding onto my belongings
(as outlined above) is not lawful, it would be much appreciated if you
could please take whatever legal action you feel is appropriate, on my
behalf, for the purpose of enabling Niall Fitzpatrick and Michael Keenan to
transport my belongings from 31 Kilmorey Street to my present temporary
address. Niall Fitzpatrick and Michael Keenan have both assured me that
once "the way is clear for them", they will act on my behalf regarding
the transfer of my belongings without any undue delay.
I feel I should point out that the belongings of mine which are at
present being held by Clanrye Properties, include several letters: one
of which should (I believe) contain a replacement "log book" for my car,
which I need in order to purchase Northern Ireland Road Tax with (backdated to
July 2015). Other items include a Toshiba laptop computer, several
plastic storage boxes (containing private papers of different kinds
including the originals of Post Office receipts directly connected with my
"situation"), together with a number of library books that are in need
of being returned to the local library.

Changing the subject, I also spent some time yesterday afternoon
discussing the recent £2,098.76 Canal Court Hotel charges (which I have
referred to in earlier correspondence) with Michael Keenan and
Niall Fitzpatrick; and, although Niall Fitzpatrick appears to be firmly
convinced beyond all doubt that the Housing Executive cannot under any
circumstances accept any responsibility whatsoever for any of these
charges, he did admit to me in the course of our conversation that this
was an entirely personal belief, and that he has not discussed the
matter with any of his more senior colleagues. Consequently, I asked if
I could speak with his most immediate manager, who I understand is Ms
Loma Wilson (Housing Executive Area Manager for the Newry District).
Unfortunately, this proved impossible for me to do, as Ms Wilson was on
holiday yesterday. Any legal advice you might be able to provide me with
regarding this particular aspect of my "overall situation" would also be
very much appreciated.
