RE: THE FEBRUARY 14TH 2020 ORAL HEARING OF MY PENSIONS CREDIT APPEAL

Thank you for your letter dated January 28th.

On account of the several remaining unresolved difficulties (and associated uncertainties) referred to below, I feel I cannot sensibly attend the oral hearing that has been arranged by your Office for February 14th 2020.

However, I am willing to consent to the Tribunal Hearing proceeding in my absence if it decides to do so.

Difficulty #1

In connection with an email I copied to Mr Brendan Glynn (Principle Lawyer at Patrick Hogan and Co in Ballinasloe, County Galway, Republic of Ireland) on January 29th, I have been hoping that he (or one of his colleagues perhaps) might by now have provided me directly, or indirectly via my brother (Mr Gerald Finnerty) and my half-sister (Ms Marjorie Dolan), with a written explanation as to why his law-firm originally refused to secure the loans received by me from my brother and half-sister against my home in County Galway.

As I understand it, the fact that the loans in question have not been secured is, in effect, the only reason my Northern Ireland Pension Credits payments were suddenly cancelled (with no advance warning and without notification) on March 21st 2019, which in turn led on directly to the cancellation of my housing benefit payments some months later.

I have been hoping that I might have received a written explanation from Mr Brendan Glynn by now (either directly, or indirectly via my brother and half-sister) regarding the reason/s Patrick Hogan & Co originally refused to secure the loans in question, which my brother and half-sister originally asked lawyer Greg Nolan of Patrick Hogan & Co to implement sometime around March 2007.

Unfortunately, I have heard nothing from Patrick Hogan & Co in response to my January 29th email. Had I received the written statement I have been hoping for, it was my intention to provide the Northern Ireland Appeals Service with a copy of it well ahead of the Appeal Hearing date.

Difficulty #2 (Re: Two letters handed to me by Dr David Cheyne GP on January 24th 2020)

Letter 1

During an appointment I had with Dr David Cheyne GP on January 24th, he provided me with copies of two letters relating to my ongoing efforts to get treatment -- of a kind that makes sense to me -- for the C-PTSD (Complex Post Traumatic Stress Disorder), I have been suffering from for an uninterrupted period of 20 years or so now.

One of the letters in question, dated August 6th 2019, has been written by the Belfast Primary Care Talking Therapies and Wellbeing Hub Councillor Peter Pallin, and a scanned copy of his letter can be viewed at the following www location:

As can be seen at the www address just above, Mr Pallin's letter contains no mention at all of the letter I sent through the registered post to Consultant Psychiatrist Dr Paul Bell on November 3rd 2018, a scanned copy of which can be viewed at:

My letter to Dr Bell at the address immediately above was an attempt by me to try to ensure, for the purpose of I being provided with proper treatment (as I see it) for the C-PTSD I am suffering from, that the growing set of difficulties I listed at the address just above might make it more easy for others to see the "overall problem" in a holistic way: i.e. "Holistic" as in "characterized by the belief that the parts of something are intimately interconnected and explicable only by reference to the whole".

I tried to ensure that Mr Pallin was fully aware of my November 3rd 2018 registered letter to Dr Bell using the letter I sent through the registered post to Mr Pallin on July 23rd 2019, a scanned copy of which can be viewed at:

For some reason unknown to me, it appears (to me) that Mr Pallin must have decided to ignore (more or less) the contents of the July 23rd 2019 letter at the address just above; and, he certainly refused very strongly, and absolutely, to discuss any of the message-text contents with me.

As Mr Pallin has mentioned the subject of "anger issues" of mine in his August 6th 2019 letter, and for the benefit of those who might not know, I feel I should point out here that angry outbursts are a recognised symptom of C-PTSD, as evidenced in the list of symptoms at:

I would also like to point out that I tried to minimise the risk of my C-PTSD symptoms being exacerbated, through the use of the registered letter I sent to Dr David Cheyne GP on December 13th 2018, as can be seen in the scanned copy of that letter at:

I do not know why Dr Cheyne GP was unable to meet the request I made in the letter referred to in the paragraph immediately above.

One further matter, which puzzles me, is that Mr Pallin's letter dated August 6th 2019 (referred to above) is addressed to a "Dr Dunlop", who I believe is Dr Holly Dunlop GP at the Ormeau Road Surgery, where I am a patient. Please know that I have no recollection of ever meeting Dr Holly Dunlop GP, or of ever communicating with her in any way. The only medical doctor I have ever communicated with at the Ormeau Road Surgery is Dr David Cheyne GP.

Letter 2

The second of the two letters, handed to me by Dr Cheyne GP on January 24th, was dictated by Consultant Psychiatrist Dr Barbara English on August 30th 2019, and a scanned copy of it can be viewed at:

As can be seen in the scanned copy of Dr English's letter at the address immediately above, Dr English "does not see that secondary care Psychiatric Services have anything further to offer Mr Finnerty (myself) at this point." As Dr English has not made any mention of my letter to Dr Paul Bell dated November 3rd 2018 (referred to above), my feelings about taking the psychotropic and antipsychotic medications Dr Bell suggested I consider remain as stated in Section 5 of my November 3rd 2018 letter to Dr Bell.

Dr English's August 30th 2019 letter was also addressed to Dr Holly Dunlop GP.

In connection with both Dr English's and Mr Paul Pallin's letters (referred to above), I feel I should also point out that I have never received any reply of any kind to the letter I sent through the registered post to Psychiatric Nurse Helen Elder on August 2nd 2019, a scanned copy of which can be viewed at:

Also, I would like to take this opportunity to point out to you and your colleagues at The Primary Care Talking Therapies and Wellbeing Hub that the type of "talking therapy" I have long since felt most in need of, and which I believe would be of most benefit to me, is the kind which is supportive of -- and which is capable of empathising with -- the observations set out in the "Dealing with injustice" article written by Clinical Consultant Psychologist Dr Marie Murray for the Irish Times several years ago. As a matter of interest, it is my understanding that Clinical Consultant Psychologist Dr Marie Murray is a graduate of Queens University Belfast.

On January 24th I asked Dr Cheyne GP if it would be possible for him to refer me directly to a suitably qualified and experienced psychologist; and, assuming I understood him correctly, it appears that he cannot do this, because he is not allowed to apparently.

I feel I should also make it clear that I still do not have any access to professional legal advice, or representation.

Although I am not sure how relevant it is (if at all) to my Pensions Credit Appeal, I nevertheless feel I should inform you that The Disability and Carers Service (Castle Court, Royal Avenue, Royal Avenue, Belfast BT1 1HR) have entitled me to "Attendance Allowance" from and including November 14th 2019. Their Case Reference Number is: 3-710998.

Later today I will complete and return by post the form you included with your January 28th letter which relates to the matter of I formally consenting to the Tribunal Hearing proceeding in my absence, if the Tribunal decides to do so.
