Article
13 of the European Convention on Human Rightsby
Ainéislis Mon Mar 16, 2009
11:54It seems to me that this
pernicious assault on
Niall Harnett (by the police, in
a court room, and in the presence of a judge) should
undoubtedly be dealt with under the terms of
Article 13
of the
ECHR -- which very clearly states:
"Everyone
whose rights and freedoms as set forth in this Convention are
violated shall have an effective remedy before a national
authority notwithstanding that the violation has been
committed by persons acting in an official capacity."
From:
"The European Convention on Human Rights Act
2003 (Republic of Ireland)", the text of which is
available via:
http://www.google.com/search?hl=en&q=European+Convention+on+Human+Rights+Act+2003+&btnG=Search
.
Of course thanks to the unbelievably corrupt (and
totally perverse) support that our legal profession continues
to very vigorously provide for the insidious and extremely
menacing social
curse of
IMPUNITY, I believe it is
still highly unlikely that anybody would be able to find
ANY lawyer in the
Republic of Ireland who
is willing to even touch this case with a
60 foot barge
pole: and similarly with regard to the dozens (perhaps
hundreds?) of other cases of the same kind, relating to other
individuals and to other
"small local
communities", who are at present being bullied and
otherwise abused
"by persons acting in an official
capacity" -- for trying, against all the odds, to
LAWFULLY remedy the mountain of
political, legal,
and corporate corruption that our nation has now been
saddled with.
It's interesting that
Wikipedia
seem to have picked up on this sick (and sickening) problem
relating to the legal profession:
"
Article 13
provides for the right for an effective remedy before national
authorities for violations of rights under the Convention.
The inability to
obtain a remedy before a national court for an infringement of
a Convention right is thus a free-standing and separately
actionable infringement of the Convention." (From
http://en.wikipedia.org/wiki/European_Convention_on_Human_Rights
)
Best wishes to you Niall.
I hope you will be
able to keep on with your extremely important resistance to
what I very largely see as
"Government (i.e.
Executive, Legislative, and Judicial) Tyranny",
and I further hope it might help you to keep in mind the
centuries-old tradition we have here in Ireland whereby: "the
history of one generation becomes the poetry of the next".
Your courageous efforts on behalf of yourself and the
people of Ireland are unlikely to be
forgotten!!

"Government
Tyranny":
The kind (that is) which suggests,
among several other things,
gross ignorance
and/or almost unbelievable
contempt
amongst
lawyers, for the
"Tripartite Separation of
Powers Doctrine" which is deeply embedded in
Bunreacht na
