RE: EVICTION, AND ONGOING DIFFICULTIES WITH FINDING PROFESSIONAL LEGAL ADVICE AND REPRESENTATION

I understand I am entitled to appeal the Laganside Court set of decisions, made on May 18th 2021, to (among other things) evict me from the Belfast address I am at present living at.

Information relating to the decision to evict me can be viewed in the copy of the letter dated May 18th 2021 from Babingtons Solicitors (who are acting on behalf of Radius Housing Association) at the following www location:

For medical reasons, I feel I cannot sensibly attempt to appeal the decision to evict me without having access to professional legal advice and representation.

Despite my best efforts, and those of Belfast Health & Social Care Trust Social Worker Ms Tina Millar (and a number of her colleagues and associates) since late July 2020, I still do not have any access to professional legal advice and representation. In all, I and Ms Millar and her team, have sought help from five different Belfast law firms since July 2020, and all five have turned down my requests. The five Belfast law firms in question are 1) MSM Law, 2) McKeown & Co Solicitors, 3) O'Muirigh Solicitors, 4) Phoenix Law, and 5) Brentnall Legal Ltd. The most recent of the set of five refusals reached me on July 1st via Extern Housing Social Worker Anna O'Kane.

On account of the COVID-19 pandemic, I have reason to believe that I cannot lawfully be evicted before August 18th 2021.

As time is running out in connection with this August 18th 2021 eviction deadline, I am now wondering if you, or the Northern Ireland Department of Justice Office perhaps, might be able to help me in some way to find the professional legal advice and representation I need, before it is too late for meeting the August 18th 2021 eviction-date deadline?

The reason I feel I should appeal the eviction decisions set out in the May 18th 2021 letter from Babingtons Solicitors (referred to above), is mostly because I requested the Court Hearing of May 18th to be rescheduled until such time as I had found access to professional legal advice and representation. This request of mine for rescheduling the hearing date mainly involved two separate letters sent by me through the registered post to Listing Officer Ms Heather Mulvenna at the Northern Ireland Courts and Tribunals Service, and to Mr Ian G. McCarter (Principal Lawyer) at Babingtons Solicitors on May 10th 2021. The final paragraph of both my letters reads as follows: "Allowing for the issues referred to under 1) to 8) above, I feel I must now request a re-scheduling of the Court Hearing scheduled for 10am in Court 4 on May 18th 2021, until such time as professional legal advice and representation become directly available to me: as a matter of fact."

From my viewpoint, it appears that everything to do with the two May 10th 2021 registered letters of mine referred to above has been completely ignored, and I have not even received any acknowledgement of receipt of any kind from anybody connected with the Northern Ireland Courts and Tribunals Service, or from anybody connected with Babingtons Solicitors. In other words, the responses (to date) I have received to these two registered letters of mine, are the same as if I never sent them.

Similarly, from my viewpoint at least, it appears that everything to do with the two additional registered letters of mine, both dated May 21st 2021, to Solicitor Ms Michelle Bresland at Babingtons Solicitors, and to the Officer in Charge at Laganside Courts, have also been completely ignored. I have not received any acknowledgement of receipt of any kind from anybody connected with Babingtons Solicitors, or with Laganside Courts, for the two letters referred at the www addresses immediately below.  Scanned copies of the two registered letters in question can be viewed at:

The manner in which all four of the registered letters of mine referred to above are being completely ignored -- from my viewpoint at least -- is extremely worrying for me; and, among other things, I strongly suspect that it represents a number of very serious violations of my legal rights set out in the principles listed below under Articles 5, 6, 7, and 8 of the United Nations Universal Declaration of Human Rights, which read as follows:

Article 5:
"No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment."

Article 6:
"Everyone has the right to recognition everywhere as a person before the law."

Article 7:
"All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination."

Article 8:
"Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law."

I feel I should point out that the difficulties I have relating to the fact that I still do not personally have any direct access to professional legal advice and representation are not new to me. This particularly worrying problem of mine dates back many years, and evidence of this can be found in the letter to the then Northern Ireland Justice Minister David Hanson MP -- dated December 13th 2005 -- which was written on my behalf by Omagh-based Senior Social Worker Mr Gerard Madden, and a scanned copy of which can be viewed at:

Referring to my difficulties with finding professional legal advice and representation, part of the message text in the letter referred to at the www address immediately above reads: "His efforts to secure proper legal representation have been thwarted at every turn ..."

I now hope that you, and/or your colleagues at the Northern Ireland Department of Justice, will be able to help me find professional legal advice and representation of the kind that will enable me to appeal the eviction decisions set out in the letter dated May 18th 2021 from Babingtons Solicitors (referred to above). In the event that you and your colleagues at the Northern Ireland Department of Justice are unable to help me with this matter, it would be much appreciated if you could please direct me to some other government department which can.
