Dear Phoenix Law Team,
Subject: URGENT: Cross-Border Judicial Review concerning Systemic
Impunity, Constitutional Failures, and State-Induced Hardship
I am writing to seek urgent legal representation regarding a 28 year history of
systemic institutionalised impunity and the failure of state bodies in both the
United Kingdom of Great Britain and Northern Ireland, and the Republic of Ireland, to protect my fundamental rights.
I am now 81 years of age (DOB: 21/03/1945), and the cumulative weight of these
state-sponsored "wrongdoings" has placed me in a position of extreme medical and
financial vulnerability. I am seeking a Judicial Review to challenge the
lawfulness of the state’s persistent omission to act on my grievances, most
recently following a formal notification to (UK Prime Minister) Sir Keir Starmer KC MP on 31 March
2025.

CRITICAL COMPONENTS OF THE CLAIM
1) Financial Destitution and Legal Aid: Social Security entitlements of
mine (which include UK Pension Credit and Housing Benefit payments) have been
cancelled, since 2019 in the UK, and prior to 2015 in the
Republic of Ireland. This has forced me to borrow in the region of
€138,000 (from my brother Mr Gerald Finnerty and my late half-sister Ms Marjorie
Dolan) against my now derelict home (in the Republic of Ireland), in order to
survive. None of these loans have been repaid. This systemic withdrawal of
social security support has, among other things, effectively "thwarted" my
ability to access justice through standard legal aid channels.
2) Medical Impact & Irreparable Harm: I have suffered from
documented PTSD and C-PTSD symptoms since around 2000 as a direct result of
these ongoing issues. Furthermore, I am now suffering from incurable eyesight
deterioration. There is a high degree of urgency for legal resolution before my
health further compromises my ability to testify.
3) Constitutional Breaches & Criminal Charges: I contend that major
violations of the Irish Constitution have occurred. Specifically, there is an
extant warrant for my arrest in the Republic of Ireland (since 2015) based on
what I maintain is a "trumped-up" charge of assaulting a member of An Garda Síochána (Republic of Ireland Police
Force): an incident that arose solely while I was
attempting to report a crime committed against my home property.
4) Psychiatric Obstructiveness: I have found that the psychiatric
medical professions in both jurisdictions have repeatedly obstructed my attempts
to secure proper treatment for the trauma induced by these state actions.
Legal Necessity:
I believe my case demonstrates a "consistent pattern of gross violations" that
the domestic administrative systems are incapable of -- or unwilling to --
address. Given your firm's expertise in handling actions against the police and
complex cross-border human rights litigation, I believe you are possibly the
only practice on the Island of Ireland capable of disentangling this particular
"apparatus" of what I have come to think of as "systemic institutionalised
impunity".
