RE: REQUEST FOR LEGAL ADVICE RELATING TO EVICTION ATTEMPT
I have a number of related financial and legal problems which have been building up
since around 1998, and which are proving extremely difficult for me to
resolve. The most pressing of these problems, just now, is that I am being
threatened with eviction from the Radius Housing Association flat in
Belfast I am at present living in.
Evidence of this eviction threat can be viewed in the scanned copies of
two letters (both dated January 8th 2021) I have received from Babingtons
Solicitors, who are acting on behalf of Radius Housing Association.

I have more recently received a
Summons for Judgement in connection with this
eviction case, and have been advised that the matter is listed for
hearing on
18th May 2021 at 10am before the District Judge in Court 4
at Laganside Court House.
On February 9th 2021 I came across a piece of text at the UK government
web page
https://www.nidirect.gov.uk/articles/protection-against-eviction
which read:
"If you live in rented
accommodation, the law protects you against harassment and illegal
eviction. It is a criminal offence for a landlord to harass their
tenant. A tenant could claim damages through court action."
For a number of reasons, which include the fact that I have been suffering from
Complex-Post Traumatic Stress Disorder since around Year 2000, which I believe I am
still
not receiving
proper medical treatment for, I do feel I am being subjected to harassment from Radius Housing Association. In addition, I have heard (from a number of different
sources) that it is unlawful for landlords to attempt to evict tenants
during the Covid-19 lockdown periods. Also, I have not yet been told the
results of two appeals I have lodged with the
Northern Ireland Appeal
Service which relate directly to the eviction threat in question, and
which earlier involved the sudden cancellation -- without warning or
notification -- of my
Pension Credit payments; and, some months later,
the cancellation of my
Housing Benefit payments as well.
It seems to me that Radius
Housing, and Babington Solicitors, are possibly pre-judging the outcome
of these two appeals of mine to the NI Appeals Service, and that does
not seem right to me.
As a result of
the two cancellations referred to in the paragraph immediately above, I now have Radius Housing Association "rent arrears debt" of approximately
£9,050. In addition, and in connection with money I have needed to
borrow (since
2007) from my brother Gerald Finnerty, and my late half-sister Marjorie
Dolan, I also have financial debts relating to this borrowing from family
members. The overall sum of money I have borrowed
from my brother and half-sister to date amounts to approximately
114,600
Euros.
Up to recently, it looked as though I might have been able to get
professional legal advice on this Radius Housing Association eviction threat via local Community
Psychiatric Nurse Briana Bloomer, who, together with her colleague
Social Worker Tina Millar, had established contact on my behalf with
Belfast law-firm
MSM Law (and also with the
Belfast Law Centre). However, MSM Law has apparently decided to
disengage from this role (without providing any reason for doing so as far as I
am aware), and evidence of which can be found in the copy of the email dated

I feel I should point out that I have replied to Babingtons Solicitors
letter dated January 8th (referred to above), and a scanned copy of my
reply, dated January 20th 2021, can be viewed at:

I have also received a 2nd letter from Babington Solicitors dated April 12th
2021, and a scanned copy of it can be viewed at:

As can be viewed at the www address immediately above, the April 12th
2021 letter from Babington Solicitors contains no mention at all of the
registered letter I sent to them on January 20th 2021, which according
to the Royal Mail was successfully delivered on January 21st 2021.
It
appears to me that Babington Solicitors may have decided to completely ignore
the contents (and the existence) of my January 20th 2021 registered
letter to them, and this seems strange, and worrying, for me.
In an effort to demonstrate that my
"Radius rent arrears problem"
does not the exist in isolation, and is in fact (as I see it) just a
relatively small symptom (for me) of a combination of far more serious social
problems, I have added a section titled
"CLOSELY RELATED ISSUES" at the bottom of the www address provided
immediately above.
