RE: "THE RIGHT TO AN EFFECTIVE REMEDY"

For several years now I have been searching -- entirely in vain so far unfortunately -- for professional legal advice and representation of the kind which recognises and supports human rights law, and constitutional law, in meaningful and practical ways.

As a direct result of "traumas and stresses over years", which "have come at the hands of individuals and public officials and bodies", I have been suffering from PTSD (Post Traumatic Stress Disorder), and C-PTSD (Complex-Post traumatic Stress Disorder) type symptoms since Year 2000. To date, I have never received any proper medical treatment for the very negative and life-changing PTSD type psychiatric injuries involved, from any of the several psychiatrists and psychologists I have been put in contact with through the GPs (General Practitioners) I have sought help from during the past 20 years or so. In addition, my efforts to get proper legal representation have, like my efforts to get proper medical treatment for my PTSD/C-PTSD injuries, been "thwarted at every turn".

Among a number of other important issues, the PTSD and C-PTSD type psychiatric injuries I suffer from have meant that it has been completely impossible, more or less, for me to have had anything remotely resembling a normal social life, for well over 20 years now.

Some of the earlier evidence of the medical and legal problems of mine referred to in the paragraph immediately above can be viewed in the texts of a) the letter written on my behalf by Senior Social Worker Gerard Madden dated December 13th 2005 to the then Northern Ireland Justice Minister David Hanson MP, and b) in the "To Whom It May Concern" letter dated October 28th 2005 written by Dr Michael McCavert GP on my behalf. Part of the reason I am writing to you now is because I am deeply concerned about eviction decisions (involving myself) made by a Laganside District Court Judge on May 18th 2021. My concerns are mostly to do with the fact that the District Court Judge in question, whose identity is not known to me, appears (to me) to possibly have deliberately decided to completely ignore a request from me for an adjournment of my case hearing on May 18th 2021: until such time as I personally had found direct access to professional legal advice and representation.

I have received an email dated May 28th 2021 from Ms Rosemary Wood, at the Northern Ireland Lord Chief Justice's Private Office, informing me that I am entitled to lodge an appeal relating to the Court decisions referred to in the scanned copy of the May 18th 2021 letter to me from Babingtons Solicitors (who are acting on behalf of Radius Housing Association) at:

As can be seen at the www location immediately above, please know that I provided a list of eight reasons for requesting the May 18th 2021 court hearing of mine to be re-scheduled.

I feel I should point out that part of the text in a "pdf file" attached to an email dated July 19th 2021 I have received from Northern Ireland Justice Minister Ms Naomi Long MLA reads as follows:

"My officials have confirmed that your correspondence was brought to the attention of the District Judge on 11 May, who decided to proceed with the case as scheduled. The normal procedure is that the staff would refer the adjournment application to the District Judge and then inform the person applying for the adjournment of the outcome.

"Unfortunately you were not issued with an acknowledgement of receipt of your correspondence or the decision relating to the adjournment request. This falls below the level of service expected and NICTS officials apologise for this oversight."

It would be much appreciated if you could please provide me with legal advice regarding the possibility, and the feasibility, of I appealing the May 18th 2021 court decisions. While I have been informed that I could, in theory at least, appeal the May18th 2021 case decisions by myself, in practice however, and mostly because of the PTSD/C-PTSD type symptoms I suffer from (referred to above), and which I believe I am still not receiving any proper medical treatment for, I feel I cannot sensibly try to lodge the appeal without the help of a professional lawyer.

Provided the legal and medical difficulties I am experiencing are viewed in a holistic way by the Legal Aid Agency, particularly relating to the large sum of money (of approximately 116,000 Euros according to my records) I have borrowed against my home (in New Inn, County Galway, Republic of Ireland) from my brother (Mr Gerald Finnerty, and my late half-sister (Ms Marjorie Dolan), I believe I would be eligible for Legal Aid.

By "HOLISTIC" I mean:  "As characterized by the belief that the parts of something are intimately interconnected and explicable only by reference to the whole"; and, in relation to medical matters: "As characterized by the treatment of the whole person, taking into account mental, social and legal factors, rather than just the symptoms of physical and/or psychological injuries and disease".

With further reference to the Radius proposal settlement, I would be very grateful is you could also advise me please as to whether, or not, you believe it would be in my best interests to go along with the Radius Housing settlement proposal set out at the www address immediately above, having due regard for the fact that I strongly believe I should, if it is at all possible for me to do so in practice, lodge an appeal against the decisions made against me by the District Court Judge at the May 18th 2021 court hearing referred to above.
