procedural quagmire, when
Mr Justice Tom Smyth refused
to accept affidavits and threw them back over the bench at us.
The case then unravelled when he refused our motion for oral
cross-examination of witnesses, and critical evidence, was
excluded. The excluded evidence went to the heart of the case,
and we were unable to legally prove that new national
monuments had been discovered."

I have
withdrawn my Supreme Court appeal in return for their (
Chief Justice
John L. Murray's and Justice Smyth's) agreement not
to pursue me personally for costs, estimated in the region of
600,000 euros."

How extremely convenient
that must be for certain of those deeply involved in this
heritage outrage: almost certainly the very greatest in the
history of our State.
I'm delighted by the fact though
that none of the protesters have been criminalised: that
definitely is a good achievement, and much credit is due to
all involved in producing this very useful, historic, and
truly remarkable piece of success.
Allowing for the
fact that
"All (13) cases were dismissed" (and thrown out
of court this week), will the State now be paying the
legal bills of the several protesters involved I
wonder?
Most
important of all though, I'm wondering if our National Monuments
(Amendment) Act 2004 has survived this week's
"Tara Protesters Trim Court Case" completely intact and
unscathed? -- so that it can possibly be used again (and again
maybe!!) in the future to "lawfully" destroy yet more of our
heritage sites, such as the one shown at http://www.indymedia.ie/article/83306 for example
