I am submitting this application for leave to appeal the decision dated July 28th, 2023. I respectfully request that the Commissioner consider the following context as part of my application.

For over 25 years, I have made repeated efforts to obtain professional legal advice and representation regarding a sustained pattern of wrongdoings by public bodies and officials. Some of these wrongdoings have been independently documented by my GP, Dr Michael McCavert, in his letter dated October 28th, 2005. Despite my persistent efforts, these attempts have consistently been met with silence, refusal, or deflection.

To date, I have not been able to secure legal support from any solicitor or law centre to assist me in identifying and presenting a formal “point of law” for this appeal. I believe this lack of legal access—well documented over the years and supported by medical and professional records—not only denies me the right to a fair hearing, but also obstructs access to an effective remedy under:

  • Article 8 of the Universal Declaration of Human Rights

  • Articles 6 and 13 of the European Convention on Human Rights

  • Article 47 of the Charter of Fundamental Rights of the European Union

  • The general principles of natural justice

The legal and health consequences of the original wrongdoings—including the continued existence of an unresolved warrant in the Republic of Ireland—have prevented me from accessing necessary healthcare, returning to my home, or restoring financial stability. These challenges have compounded the injustice and distress I continue to experience.

The circumstances of this case also reflect a broader concern relating to the principle of legal accountability. Over a prolonged period, the denial of access to legal advice and representation grounded in human rights and constitutional law has allowed serious procedural and substantive issues to remain unaddressed. This situation has contributed to what I respectfully submit amounts to de facto legal impunity—where violations of law and justice have gone without remedy or accountability. I believe this has further undermined the fairness of the original proceedings and raises fundamental concerns about the administration of justice in my case.

In light of the above, I respectfully ask that the Commissioner take into account:

  • My ongoing and well-documented inability to access legal advice

  • The relevance and severity of the original and ongoing wrongdoings

  • The need for procedural fairness and flexibility in these exceptional circumstances

If needed, I am willing to provide further documentation or clarification.
