Dear Chief Commissioner Kilpatrick,
SUBJECT:
Request for Guidance Concerning Access to an Effective Remedy (Reference Article
8 of the United Nations Universal Declaration of Human Rights, and related
legislation) and Possible Human Rights Implications.
I am writing to seek the assistance and guidance of the Northern Ireland Human
Rights Commission regarding matters which I believe raise serious questions
concerning access to justice and the availability of an effective remedy for
alleged violations of fundamental rights.
I am 81 years of age and have spent approximately the past 28 years attempting
to obtain legal advice and representation in connection with a number of
interconnected issues involving public authorities and institutions in The
United Kingdom of Great Britain
and Northern Ireland, the Republic of Ireland, and the European Union.
Throughout this period, I have made repeated efforts to obtain legal assistance
from a range of legal practitioners and organisations. Despite these efforts, I
have been unable to secure representation capable of examining the overall
situation in a comprehensive manner. As a consequence, I remain uncertain as to
whether any effective legal remedy exists for the matters concerned.
My concerns include issues relating to access to justice, social security
matters, alleged constitutional and human rights violations, the actions and
omissions of public authorities, and the impact these matters have had on my
physical and psychological wellbeing.
I appreciate that, as I understand it, the Northern Ireland Human Rights
Commission is not a general legal practice, and cannot provide a professional legal
representative for every individual who contacts it. Nevertheless, I am
respectfully seeking the guidance of a professional lawyer regarding the
following questions:
Does my long-standing and ongoing inability to obtain professional legal advice
and representation, and meaningful examination of these matters, raise issues
relating to the right to an effective remedy, and to access to justice under
applicable human rights standards?
In particular, I would be grateful for any guidance the Commission may be able
to provide regarding:
1) Whether the circumstances outlined above appear to raise issues within the
Commission's remit?
2) Whether there are any legal mechanisms, organisations, or specialist
practitioners that the Commission believes may be able to assist?
3) Whether there are any recognised procedures through which concerns regarding
the absence of an effective remedy may be examined?
For background information, I have documented many aspects of the matters
concerned on publicly available websites, 3 examples of which I have
provided at the end of this letter. Should you wish, I would be pleased to
provide the Commission with direct www links to the most relevant parts of the
overall set of unresolved problems pertaining to my particular case, if the
Commission considers this appropriate.
It is my understanding that the Commission receives many requests for
assistance. However, given my age, the fact that I suffer from a number of
serious health conditions, and the length of time these matters have remained
unresolved, I would be very grateful for any guidance the Commission may be able
to provide.
Before ending this letter I feel I should point out that, during recent months,
I have come across some scholarly texts from two books titled -- "LEGAL
BUT CORRUPT: A NEW PERSPECTIVE ON PUBLIC ETHICS" and "UNMASKING ADMINISTRATIVE
EVIL" -- which I believe are very relevant to my particular case.
