Thank you for your email seeking representation at your appeal on 28 July 2023. Unfortunately we will not be available to provide representation at this hearing. We have previously advised in relation to your appeal and indicated that your case relates mainly to two findings of fact:

 

1. What is the valuation of the Galway property as of April 2019; and

2. Is it accepted that you received loaned money from family which exceeded the value of the property and was secured against this property.

 

In order for us to assist in providing representation at your case it was necessary for you to provide evidence that the loans were secured against the property and the valuation of the property as of 2019. As this information was not provided your case was closed. The elements of your case relating to the valuation of your property in the Republic of Ireland and the formation of a secured loan agreement are not matters on which we can advise. We had previously advised you to seek assistance via the Law Society of Northern Ireland to instruct a private solicitor to assist you to obtain evidence that the property was secured.

 

We do not have capacity to provide representation at the hearing on 28 July 2023. In addition, we cannot assist you further from a merits perspective without evidence that your property is valued less than €60,000 or that your property has been secured against the loans received.

 

Your tribunal has an inquisitorial role and it has directed you to obtain the evidence necessary to support your appeal. It can make a finding of fact in your favour but will normally require evidence to support this conclusion. Your tribunal can proceed even if you are unrepresented and in our opinion the most important issue for the success of your appeal is the valuation of the property and the evidence of the secured loan agreement in 2019.

In connection with a very long-standing series of failed efforts of mine to find professional legal advice and representation relating to legal issues which date back to well before Year 2000, I have received an email dated June 28th 2023 from Mr Hedley Abernethy, Research and Constituency Manager, acting on behalf of Ms Kate Nicholl MLA of the Alliance Party of Northern Ireland. The several legal difficulties I am at present struggling with are in very large part (as I see it) the ongoing product of "wrong doings" at the hands of "individuals and public officials and bodies", since well before Year 2000, referred to by Dr Michael McCavert GP in his "To Whom It May Concern" letter dated October 28th 2005, a scanned copy of which has been placed at:
