Tripartite Separation
of Powers Doctrine AbandonedThe Constitution of the Republic of
Ireland, according to O'Dalaigh
CJ. in In re Haughey (1971), is founded on
the doctrine of the tripartite division of powers of
government - 1) Legislative (Oireachtas), 2)
Executive (Government Cabinet Ministers), and
3) Judicial (Courts).
Why has this
core-issue doctrine, which is designed
primarily to protect against the well known and all too
frequent horrors associated with government bullying and
tyranny -- despotism in other words -- and
the origins of which can easily be traced back to the
"golden" days of Ancient
Greece, been abandoned (for all practical
purposes) by the legislative and judicial branches of
the Republic of Ireland's overall Government (as well as
the executive); and, by the Republic of Ireland's entire

Little by
little, and completely unnoticed by the vast majority of
citizens, the Republic of Ireland's Constitution
(Bunreacht na hEireann) has slowly but surely, quietly
and slyly, been hijacked over a period of several
years.
Now, in reality, the written Constitution
of the Republic of Ireland is lost to the people of the
Republic of Ireland; and, for all practical purposes,
and thanks in no small way to impunity, and to the
ignoring (by senior public officials) of letters sent
through the registered post to them, the whole overall
situation relating to this very basic and fundamental
loss is entirely outside the control of the people of
the Republic of Ireland: as things stand at the present
time.
Consequently, this extremely "hard won"
core legal document ("Bunreacht
na hEireann") no longer offers any
worthwhile, practical legal protection whatsoever to the
people of the Republic of Ireland against government
wrongdoing -- "Government" as in Executive, Legislative, and
Judicial that is (i.e. all three of the main
branches of Government) -- which is of course the
primary purpose of such constitutional
documents.
In another (of many) efforts to try
and remedy this wholly unsatisfactory situation of
several years standing, an e-mail containing the text of
a recent Open News "Diary Entry" (relating directly to
this particularly worrying issue) was sent on November
19th 2010 -- a time close to the beginning of a closely
related extended "visit" to Dublin from a dozen
or so IMF
(International Monetary Fund) officials -- to
a group of United Kingdom of Great Britain and Northern
Ireland parliamentarians.
